2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 506, 494, 307 and 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act pending in the learned court below.
3. As per the prosecution case, there is allegation against the petitioner that he has demanded dowry of Rs. 2,00,000/- from the complainant and on non-fulfillment of the demand he tortured the complainant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case.

No.51470 of 2023(2) dt.11-08-2023 2/2 He further submits that the petitioner is a poor person and working in a hotel as a labour at Narayanpur and his btoher daughters, namely, Deepa Kumari and Prity Kumari have already married. He submits that the allegation of assault as mentioned in the FIR is 31.01.2019 but the complaint case filed on 18.12.2019 and the present F.I.R. has been lodged on 05.10.2022 after a delay of more than three years from the date of alleged occurrence. He further submits that petitioner is ready to keep his wife with full honour and dignity. He submits that petitioner has got no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State opposes for prayer for bail.

Considering the aforesaid facts and circumstances, let the petitioner, named above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Korha P.S. Case No.440 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
