ANJANA MISHRA ORAL ORDER 16-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Piprakothi P.S. Case No. 180/13 registered for the offences punishable under Sections 498-A, 379, 323 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The petitioners are the direct relations of the husband of Kiran Devi, being the brother and mother of the husband of Kiran Devi.

Learned counsel for the petitioner submits that they have been roped into the present case making false allegations. However, there is no specific allegation against these petitioners. It is also submitted that the husband had been making all out

Patna High Court Cr.Misc. No.43800 of 2014 (2) dt.16-04-2015 P2/2 efforts to persuade the said Kiran Devi to live with him but she has refused to live with him and lodged this case. Considering the aforementioned submission and also the fact that they have no specific role to play in the present case, let the petitioner, in the event of their arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Motihari, E. Champaran in connection with Piprakothi P.S. Case No. 180/2013 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
