In this case, the petitioner is seeking anticipatory bail in connection with Chakia P.S. Case No.327 of 2018, registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

Allegation against the co-accused including the petitioner is to have committed the dacoity in the house of the informant, however, counsel for the petitioner submits that name of the petitioner has come during investigation in the confessional statement of co-accused.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner.

However, if the petitioner surrenders before the Court below within four weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
