17-04-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Manihari P.S. Case No. 169 of 2012, registered for the offence under Sections 363, 366(A), 506/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that though, case was instituted for abduction of daughter of informant against the petitioner and his father, but now, the victim and petitioner have got married and are living together, as husband and wife and to that effect, the victim has also filed a petition before the Inspector General of Police, Tirhut Division, Muzaffarpur (Annexure - 2 to the petition). It is further submitted that out of the wedlock two children have born. Sri Rakesh Kumar Singh, learned counsel, appearing on behalf of informant, does not dispute the submission made

Patna High Court CR. MISC. No.8109 of 2021(2) dt.17-04-2021 2/2 on behalf of the petitioner and submits that the victim and this petitioner have married and are living together, as husband and wife.

Considering the aforesaid facts & circumstances and the fact that petitioner has already married with victim and they are leading peaceful conjugal life, the bail application of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Muzaffarpur in connection with Maniyari P.S. Case No. 169 of 2012, on the following conditions:

"(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on his absence on two consecutive dates without sufficient reason, his bail-bond shall be cancelled by the court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
