====================================================== CORAM: HONOURABLE JUSTICE SMT. NILU AGRAWAL ORAL ORDER 04-05-2016 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner, who is cousin father-in-law of the deceased Chanda Devi, apprehends arrest in connection with Muffasil P.S. Case No. 247/15 for offences alleged under Sections 304-B, 506/34 of the Indian Penal Code.

The prosecution case, as lodged by the informant, is that on 05.12.2015 at about 8.30 A.M. informant received information from the villagers that all the Sasural people including the petitioner administered poison to her daughter and killed her. On such information he along with villagers reached her sasural and did not find any member of the family.

It has been submitted by the learned counsel for

No.17735 of 2016 (2) dt.04-05-2016 2/2 the petitioner that he has a separate house from that of the deceased and her husband, no specific allegation has been attributed against him, there is no eye-witness to the said occurrence and the husband of the deceased Mausam Singh is in judicial custody. It has further been submitted that one Pappi Devi, the cousin mother-in-law of the deceased, has been granted the privilege of anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 11350 of 2016 on 16.03.2016. However, learned APP for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.

Be that as it may, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Munger, in connection with Muffasil P.S. Case No. 247/15, subject to the conditions as laid down under Section 438(2) Cr.P.C.
