JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 504/34 of the Indian Penal Code section 3(1)(v)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is that on 25.8.2015 the informant had gone to cut grass when the petitioners came near the informant. Petitioner Suresh Singh tried to strangulate the informant by putting towel around his neck, petitioner Rajesh Singh assaulted the informant by sleeper and Suresh abused the informant by calling the caste name.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.18202 of 2016 (2) dt.27-04-2016 2/2 that as per own admission of the informant, the accusation has been levelled in the background of some dispute from before. It is further submitted that for the occurrence of 25.8.2015 the FIR was registered on 3.9.2015. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the delayed lodging of the case and the accusation being levelled in the background of some dispute from before, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Narkatiaganj, West Champaran in connection with SC/ST (West Champaran, Bettiah) P.S. Case No.15 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
