Petitioner seeks bail in a case registered for the offence punishable under Section 306 of the Indian Penal Code. The daughter of the informant committed suicide by putting herself before a running train. Allegation against the petitioner is of abetment to commit suicide and that allegation is based on suspicion that the petitioner had demanded rupees nine thousand to get the victim passed in the examination wherein she has already failed.
Since allegation against the petitioner does not make out a case of direct abetment or inducement to commit suicide, let the petitioner, above named, be released on bail on furnishing
Patna High Court CR. MISC. No.48595 of 2019(2) dt.05-08-2019 2/2 bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kishanganj Police Station Case No. 215 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
