This application, for grant of anticipatory bail, arises out of Digha Police Station Case No. 254 of 2020, disclosing offences under Section 414 of the Indian Penal Code. As per the prosecution case, the raiding party searched the house of co-accused, Mohan Kumar, wherefrom a number of articles like wrist watch, silver coins, golden ornaments and a number of 34 articles were recovered. The coaccused Mohan Kumar could not produced relevant papers, in relation to the seized articles. He disclosed the name of present petitioner and other accused persons and appraised the police party that the present petitioner and other named persons used to

The learned Counsel for the petitioner has submitted that the name of the petitioner has come in the confessional statement of the co-accused and there is nothing against him except that statement.

On the other hand, learned Addl. P.P. has opposed the prayer for anticipatory bail.

The criminal antecedent of the present petitioner has been mentioned in para No.3 of the bail application which shows that the other cases of similar nature are pending against the petitioners and in the present case also, there is allegation that he used to sell the stolen articles to co-accused, Mohan Kumar, as such, it is not a fit case of anticipatory bail. Accordingly, the prayer for anticipatory bail is hereby rejected.
