JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-04-2015 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Initially notices were issued to opposite party no.2 on 08.05.2014 which were received by the mother of opposite party no.2, thereafter notices were issued to opposite party no.2 as well as opposite party no.3 who is alleged second husband of opposite party no.2 on 20.10.2014 when office note dated 20.03.2015 reflected that notices were served on opposite party no.2 then fresh notices were issued to opposite party no.3 on 23.03.2015, but none is appearing on behalf of opposite party no.3. The basic accusation is of torture for non-fulfilment of

Though, a statement has been made in para 6 of the petition that the petitioner is still ready to keep the informant as wife with full dignity and honour but considering the fact that in spite of valid service of notice, opposite party no.2 failed to appear before this Court, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Madhubani in connection with Khirhar P.S. Case No. 43 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
