Explanation is accepted.

The petitioner is languishing in custody for the offences punishable under Sections 8/20(b)(ii)(B) of the N.D.P.S. Act.

Allegation is that 4 Kgs of Ganja was recovered from the possession of the petitioner. The petitioner is in custody since 07.09.2020.

Submission is that the petitioner has got no criminal antecedent and the recovered quantity is less than commercial

Considering the submission aforesaid and completion of investigation coupled with no material to substantiate that the petitioner is coming to tamper with the evidence, let the petitioner, above named, be released on bail after framing of the charges, if it has not framed as yet, so that trial may not hamper on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sahodra P.S. Case No.45 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
