Petitioner seeks modification of the order dated 16.05.2014 passed in Cr. Misc. No. 13417 of 2014 whereby he was granted the privilege of anticipatory in connection with Forest Case No. 63 of 2012 pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabua and prays for extension of time to surrender and furnish bail bonds granted under the said order by further three weeks.
Learned counsel for the petitioner submits that petitioner had no knowledge about the order passed on his bail application as he had gone to Punjab for earning his livelihood. Though in January, 2015, he had come to his village to see his ailing father, but at that time also he could not know about the bail
Patna High Court Cr.Misc. No.17844 of 2016 (2) dt.06-05-2016 2/2 order. Again he came to his village on the occasion of Holi in 2016, then only he could know about the bail order while Chawkidar had come with warrant of arrest.
For the reasons indicated in the modification application, I am satisfied that due to lack of knowledge, petitioner could not surrender and furnish bail bonds within the time granted under the aforesaid order.
Accordingly, time to surrender granted under order 16.05.2014 passed in Cr. Misc. No. 13417 of 2014 is extended by further three weeks from today and the said order is modified to the extent indicated above.
