The petitioner seeks bail in Barun P.S. Case No. 209/2018, instituted for offence under Section(s) 302, 201, 120(B) of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that F.I.R. is against unknown.

It is alleged in the written report that on 31.10.2018 while informant/Chaukidar was returning to house after performing night duty and reached near Chimani Bhattha of Santhua More, he saw some persons had assembled near bush where he found a dead body was lying in the bush. Thereafter he informed the police. The police party reached there and dead

Patna High Court CR. MISC. No.47336 of 2019(2) dt.05-08-2019 2/2 body was sent to Sadar Hospital for post-mortem. Thereafter the instant case has been registered on the basis of Fardbeyan. Learned counsel for petitioner has submitted that petitioner was arrested in Nabinagar P.S. Case No. 328/2018 on 18.11.2018 and thereafter he has been remanded in the instant case on 15.01.2019 merely on suspicion after recording his confessional statement by the police in that case. Petitioner is in custody since 15.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 209/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
