Petitioner is in custody in connection with Basnahi P.S. Case No. 45/18/Special Excise Case No. 284 of 2018 for the offence under section 30(a), 38(i) and 41(i) of the Bihar Prohibition Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody in connection with seizure of 86.250 liters of Mahua wine. Learned counsel for the petitioner submits that petitioner is in custody since 18.5.2018.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody for more than one and half months, let the petitioner, named above, be enlarged on

Patna High Court Cr.Misc. No.39597 of 2018(2) dt.09-07-2018 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Saharsa, in connection with Basnahi P.S. Case No. 45 of 2018 Special (Excise) Case No. 284 of 2018.
