The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code and under section 27 of the Arms Act.
Villagers of two villages came and begun to fire. It is alleged that petitioner made firing which hit Karu Singh. The learned counsel for the petitioner submits that petitioner did not fire and in paragraph 10 of the case diary the witness says that villagers of Karu Singh fired which accidentally hit Karu Singh but from the FIR itself it appears that informant made very specific allegation that it was the petitioner who fired causing injury to Karu Singh and Karu Singh received three injuries caused by fire arm.
Patna High Court Cr.Misc. No.16284 of 2016 (3) dt.01-07-2016 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
