The petitioner seeks bail in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 177 of 2021 instituted for the offences under Section 414 of the Indian Penal Code and Sections 30(a) and 30(b) of the Bihar Prohibition and Excise Act, 2016.
20 litres of liquor is said to have been recovered by the road side and the petitioner is sought to be prosecuted in this case on the basis of the suspicion that he is involved in storing the aforesaid liquor.
It has been submitted on behalf of the petitioner
Patna High Court CR. MISC. No.61462 of 2021(2) dt.26-05-2022 2/2 that because of the suspicion of the police, he has been remanded in six others cases of similar nature; but in all such cases, he is on bail.
In the present case, the petitioner is in custody since 15.07.2021.
Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 177 of 2021.
The application stands allowed.
