1. Since all these three anticipatory bail applications arise out of Kachhawan Police Station Case No. 119 of 2024, with the consent of the parties, all these applications are heard together.
2. Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State, in all the three applications.
3. These applications, for grant of anticipatory bail, arise out of Kachhawan Police Station Case No. 119 of 2024, disclosing offences punishable under Section 406 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act, 1961.

The prosecution case, as per the First Information Report, is that the marriage of the daughter of the informant was fixed with the petitioner, namely, Shrikant Kumar, and on 28.11.2023, their engagement took place, in which the informant has given one golden chain, worth Rs. 55,000/-, Rs. 11,000/- in cash and other gift items, worth Rs. 25,000/- to the petitioners. On demand made by the petitioners, the informant, on 04.12.2023 and 15.12.2023,
3/5 transferred a total amount of Rs. 2,00,000/- in the bank account of petitioner Shrikant Kumar. It has further been stated that when the informant told the petitioners to fix the date of marriage, the petitioners demanded more money, upon which, the informant, along with others, went to the house of the petitioners and gave Rs. 2,25,000/- in cash. After receiving the amount, the petitioner Gorakh Singh told the informant to fix the date of May, 2024, for the marriage. It has further been stated that on 01.03.2024, co-accused Jai Govind told the informant that the petitioner Shrikant Kumar has secured a job and demanded Rs. 10,00,000/-. When the informant showed his inability to pay such a huge amount and returned to his house.

It has been alleged that a panchayati was held between the parties in which he petitioner Gorakh Singh refused to marry his son with the daughter of the informant and when the informant demanded his money back, the petitioners gave him Rs. 2,00,000/- only and refused to pay the rest amount of Rs. 3.25 lakhs.
6. Learned Counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated
4/5 in this case with mala fide intention and ulterior motive. He further submits that the informant has performed second marriage and the girl with whom the marriage of petitioner Shrikant Kumar was fixed, was born out of the second marriage of the informant and this fact has been suppressed by the informant while fixing the marriage. When the petitioners learnt about this fact, they refused to marry with the daughter of the informant and in a panchayati held for this purpose, the petitioner Gorakh Singh returned the entire amount of Rs. 2,00,000/-, which was given by the informant to the petitioners by way of gift. He further submits that the allegation of demand of Rs. 10,00,000/- and a bullet motorcycle as dowry is totally incorrect.
7. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the nature of allegation against the petitioners, upon which custodial interrogation of the petitioners may not be required, I am inclined to grant the petitioners privilege of anticipatory bail.
8. These applications are, accordingly, allowed.
9. Let the petitioners, above named, in the event of their
5/5 arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate III, Bikramganj, Rohtas, in connection with Kachhawan Police Station Case No. 119 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
