2. Petitioner seeks regular bail in connection with Hajipur Town P.S. Case No.469 of 2025 registered under Sections 8(c) and 21(a) of the N.D.P.S. Act and Sections 304(2), 62 and 3(5) of the B.N.S., 2023.
3. There is recovery of 3.85 mg heroin from the pocket of co-accused Rishu Singh, who has named the petitioner and other co-accused as his companion. It is alleged that one motorcycle was also seized.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The name of petitioner has surfaced by co-accused Rishu Singh who is neighbour of the petitioner with whom there is a
Patna High Court CR. MISC. No.51917 of 2025(2) dt.11-08-2025 2/2 land dispute. Nothing has been recovered from possession of the petitioner. The alleged recovery made from the co-accused is also of small quantity. Petitioner has no concern with the coaccused or with the seized materials. The charge sheet has already been submitted and there is no chance of tampering with the evidence or absconding of petitioner. Petitioner has no criminal antecedent and he is in jail since 27.04.2025. Petitioner undertakes to cooperate in the trial.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Principal District and Sessions Judge, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No.469 of 2025.
