The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 323, 308, 379, 354 and 504 of the Indian Penal Code. It is alleged that petitioner no.1 assaulted the informant with iron rod and, thereafter, the other petitioners assaulted the informant with lathi, fists, slaps and legs. The accused persons also assaulted son of the informant and petitioner no.1 snatched Rs.35,000/-, a wrist watch and a mobile from the informant. Petitioner nos.2 and 3 snatched jewellary
Patna High Court Cr.Misc. No.15859 of 2015 (2) dt.16-04-2015 2/3 from the wife of the informant.
It is submitted by learned counsel for the petitioners that the informant has not received any injury and also no injury report is on record. The accusation of assault is omnibus and general against all the petitioners and with regard to the injury caused to the son of the informant, injury no.1 has been found simple in nature with regard to injury no2, opinion has been preserved. It is further submitted that at earlier point of time petitioner no.2 lodged Katra P.S. Case No.170 of 2014 under sections 147/148/149/341/323/324/307/354/379/504 of the Indian Penal Code against the informant and, thereafter, the present case has been lodged on 26.11.2014 under sections 147, 148, 341, 323, 308, 379, 354, 504 of the Indian Penal Code. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Darbhanga in connection with Singhwara P.S. Case No.258 of
Patna High Court Cr.Misc. No.15859 of 2015 (2) dt.16-04-2015 3/3 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
