The Petitioner apprehends his arrest in connection with Dumaria P.S. Case No. 62 of 2015 registered for offence punishable under Sections 341,323,324,307/34 of the Indian Penal Code.
Specific allegation upon the petitioner is that he has assaulted several times to the informant by sword. However, injury report shows that there are four incised wounds caused by sharp cutting weapon but all are simple in nature. It appears from the Annexure-2 that all the wounds are either on the head or neck or ear of the informant and allegation on the petitioner in the First Information Report shows
Patna High Court Cr.Misc. No.18488 of 2016 (2) dt.06-05-2016 2/2 that several blows were made but fortunately it could not cause any grievous injury and the informant somehow escaped. In view of such serious nature of the allegation, this court is not inclined to grant the anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail is hereby rejected.
