JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-06-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel for the informant.

The petitioner apprehends arrest in connection with Buxar Town P.S. Case No. 326 of 2009 registered under section 498-A of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of Priyanka Kumari, daughter of the informant Badrinarayan Gupta. It is also submitted that the said Priyanka Kumari is at present residing at the house of the petitioner and the petitioner is still ready to keep her with full honour and dignity.

Patna High Court Cr.Misc. No.12968 of 2015 (2) dt.01-06-2015 Having considered the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender within four weeks, be enlarged on provisional bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Buxar Town P.S. Case No. 326 of 2009, subject to the conditions laid down under Section 438(2) Cr.P.C.

Learned trial court is directed to issue notice to the informant and her daughter Priyanka Kumari and make all attempt to resolve the dispute in between the petitioner and his wife Priyanka Kumari by taking all possible efforts and if the dispute is resolved the trial court shall confirm the provisional bail of the petitioner. If the dispute is not resolved, then the trial court will pass order on its own merit.
