2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 307, 436, 498A/34 of the Indian Penal Code and subsequently 304(B) of the IPC has been added.
3. Petitioner along with other accused persons are said to have killed the daughter of the informant due to nonfulfillment of demand of dowry.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner. He submits that the petitioner is the husband of the deceased. He submits that till date charge has not been framed
Patna High Court CR. MISC. No.57749 of 2024(8) dt.04-03-2025 2/2 against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 13.12.2023.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case and the nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Kathaiya P.S. Case No. 162 of 2021.
7. However, petitioner is at liberty to renew his prayer for bail after framing of charge.
