JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Banka S.C./S.T. P.S. Case No. 22 of 2014 registered for the offences punishable under Sections 323, 497, 504/34 of the Indian Penal Code, 3 (i) (x) (xi) of S.C./S.T. (Prevention of Atrocities) Act and 66 (A) of I.T. Act.

It is alleged that petitioner no. 1 developed illicit relation with informant's wife who was admittedly major at the time of alleged occurrence and furthermore, it is alleged that petitioner no. 1 took the informant's wife along with her jewellery and also abused the informant calling his caste name. Petitioners no. 2 and 3 happen to be parents of petitioner no. 1

Patna High Court Cr.Misc. No.7905 of 2015 (2) dt.02-03-2015 Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Banka in Banka S.C./S.T. P.S. Case No. 22 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
