Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 409, 420, 120B of the Indian Penal Code.
It is alleged that petitioners claiming themselves to be the Inspectors under the Prevention of Cruelty to Animals Act seized animals of the informant and refused to release in spite of release order being passed by the Court. It is submitted by learned counsel for the petitioners that petitioners were appointed as Sub-inspectors and subsequently promoted as Inspectors. Their appointments and promotions gets reflected from several correspondences
Patna High Court Cr.Misc. No.46688 of 2014 (2) dt.21-04-2015 2/2 with the government and the higher police officials and officials of the department, the same have been brought on record. Considering the nature of accusation, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Barharia P.S. Case No. 18 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
