The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 420, 406, 341, 323, 506, 504, 34 of the Indian Penal Code.
It is alleged against the petitioner that she made an agreement with the informant to sell her land to the informant and also received token amount but subsequently denied to execute the land in favour of the
Patna High Court CR. MISC. No.60771 of 2021(2) dt.12-05-2022 2/3 informant.
It is submitted by learned counsel for the petitioner that the agreement which is the basis for registration of the present F.I.R is not a registered deed of agreement and in a purely civil nature of case, the petitioner has been implicated in a criminal proceeding. The petitioner is also ready to return the token amount received from the informant. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
In the facts and circumstance of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IX, Muzaffarpur in connection with Mithanpura P.S. Case No. 103 of 2021, subject to the
Patna High Court CR. MISC. No.60771 of 2021(2) dt.12-05-2022 3/3 conditions as laid down under Section 438(2) of the Cr.P.C.
