====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Hajipur Sadar P. S. Case No. 567/2024 in a case registered for the offences punishable under Sections 103(1) and 3(5) of the B.N.S. and Section 27 of the Arms Act.
3. As per prosecution case, it is alleged that all the F.I.R. named accused persons along with three unknown miscreants fired upon the son of informant as a result of which he died.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name surfaced during course of investigation in confessional statement of coaccused Vikesh Kumar @ Viksy. It is further submitted that
Patna High Court CR. MISC. No.50910 of 2025(2) dt.12-09-2025 2/2 similarly situated co-accused has already been granted regular bail by this Hon'ble Court vide order dated 16.05.2025 passed in Cr. Misc. No. 15699 of 2025. Petitioner is in custody since 13.11.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P. S. Case No. 567/2024.
