The District Magistrate, Aurangabad, has a duty to entertain the application of the petitioner for grant of benefit of ACP, which has not been granted to the petitioner for no apparent reason despite recommendation made in his favour, which will be evident from reading of Anneuxre-1.

2. The District Magistrate must take up the case of the petitioner for consideration and pass appropriate order or direction. If the petitioner is entitled to the said benefit, the same must accrue in favour of the petitioner within a period of three months from the date of production of a copy of this order.
