JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 337, 504, 427, 109, 363 of the Indian Penal Code.

The prosecution case is that the informant being officerin-charge of Sidhwaliya P.S. went to investigate Sidhwaliya P.S. case No. 57 of 2014 where he found 100-125 people obstructing the road. On protest being made, they pelted stones as a result of which the police jeep got damaged. From the assistance of local people and Chowkidar of village 25 FIR named accused were identified. It is further alleged that Vickky Ojha and Anand Mani Tripathi were leading the mob.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.18443 of 2016 (2) dt.29-04-2016 2/2 that the accusation is against the mob and the police actually disturbed the procession taken out with idol of Durga. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent and similarly situated accused have already been granted anticipatory bail by a coordinate Bench of this court vide order passed in Cr. Misc. 18066 of 2015. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Gopalganj in connection with Sidhwaliya P.S. Case No. 104 of 2014 (GR No. 3340 of 2014) subject to the conditions as laid down under Section 438(2) Cr.P.C.
