Petitioner, already in custody, seeks bail in connection with Majhaulia P.S. Case No.02 of 2018 registered under Sections 366A/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that it is a case of elopement and not of kidnapping or enticing away the girl which is reflected from the statement of the girl recorded under Section 164 Cr.P.C. wherein she states that she went voluntarily with the petitioner and married him, the girl is major as the Medical Board has assessed her age between 17 to 19 years.

Having considered the aforesaid facts and circumstances, petitioner Sajan Kumar Ram @ Sajan Ram is

Patna High Court Cr.Misc. No.41278 of 2018(2) dt.11-07-2018 2/2 directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Majhaulia P.S. Case No.02 of 2018.
