JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-04-2015 The present application has been filed for modification of the order dated 20.12.2013, passed in Cr. Misc. No. 35683 of 2013, to the extent of modification of the condition whereby the petitioner was directed to attend the court regularly till disposal of the case, and in case of failure on two consecutive dates without giving any reasonable explanation or violation of undertaking, privilege of bail granted deemed to be cancelled. The petitioner was granted bail in a case registered under Sections 323, 379, 406, 498A/34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that petitioner is a Railway employee posted at Sambalpur in Orissa, whereas the case is pending at Rosera,

Patna High Court Cr.Misc. No.14522 of 2015 (2) dt.07-04-2015 Samastipur. Statement has been made in para-5 of the petition that till date he has regularly appeared before the Court. Considering the above fact, the order dated 20.12.2013 passed in Cr. Misc. No. 35683 of 2013 is modified to the extent that the learned court below will be at liberty to cancel the bail bond of the petitioner, if the petitioner will default on four consecutive occasions during trial.
