JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448,341,323,504 and 506/34 of the Indian Penal Code and section 3(1)(x)(xi) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

The prosecution case is that the informant being Principal of Gram Bharti Graduate College, Ramgarh was abused and assaulted by the petitioners who are lecturers in the said college in the official chambers.

It is submitted by the learned counsel for the petitioners that for some time the petitioner no. 1 became Incharge Principal of the college in pursuance to the order passed in a writ

Patna High Court Cr.Misc. No.18222 of 2016 (2) dt.27-04-2016 2/2 application but subsequently the order passed in the writ application was reversed by the Division Bench in LPA, as a result, due to that resentment the present accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. It is further submitted that for the occurrence of 3.11.2015 the FIR has been registered on 5.11.2015.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Kaimur at Bhabua, in connection with SC/ST (Bhabua) P.S. Case No.52 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
