JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 4312 of 2018 (arising out Bihta P.S. Case No. 471 of 2018) for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and in the instant case five person were arrested by the police on chase in connection with seizure of 400 liters liquor from the Diara. Learned counsel further submits that in this case four persons arrested along with this petitioner has been granted bail in Cr. Misc. No. 38036 of 2018 vide order dated 02.07.2018 by this court. Considering the aforesaid fact the petitioner named above, is directed to be released on bail on furnishing bail bonds
