JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 This is an application for grant of anticipatory bail in connection with Rafiganj P.S. Case No. 46 of 2019, disclosing offences under Sections 147, 149, 341, 323, 324, 325, 504, 34 of IPC.

Allegation as per written report is that accused persons including the petitioner came variously armed and one Shailesh Paswan assaulted the father of the informant by Khanti and when he went to intervene in the matter, he was assaulted by the petitioner and other accused persons by lathi and danda. Submission of the learned counsel for the petitioner is that co-accused against whom there is allegation of assault to the father of the informant, has already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 15.05.2019 passed in Criminal Misc. No. 32216 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Rafiganj P.S.
