JUSTICE GOPAL PRASAD ORAL ORDER 23-04-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Amarpur P.S. Case No. 277 of 2009, registered under Section 379 of the Indian Penal Code.

F.I.R. is against unknown.

Learned counsel for the petitioner submits that earlier a case has been filed against the petitioner in which the petitioner was sent to jail. Thereafter he got bail. With regard to the same occurrence a petition has been filed for offence under Section 379 of Indian Penal Code and trial court rejected the anticipatory bail of the petitioner on the sole ground that cognizance has been taken under Section 379 of Indian Penal Code.

Having regard to the facts and circumstances of the case, the above named petitioner in the event of his arrest/surrender within a period of four weeks from the date of receipt of the order in the court below shall be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Randhir Kumar, Judicial
