In this case, petitioner is seeking anticipatory bail in
Patna High Court Cr.Misc. No.9942 of 2015 (4) dt.16-07-2015 2/3 connection with K. Nagar P.S. Case No. 592 of 2014 registered for offence under section 302/ 34 of the Indian Penal Code. As per the allegation made in the first information report, the petitioner has good relationship with the victim, she used to look after the victim in a good manner but later on, relationship turned strain. At 3.00A.M. in between 28-29/10/2014, when the victim was going to his field, the accused persons surrounded and assaulted him with different weapons whereupon the victim died. The case diary shows that the victim was not keeping a good character, few independent witnesses have shown the apprehension that he might have entered into the house of others whereupon he was assaulted and killed. Paragraph 10 to 14 of the case dairy support the statement of the informant but there is no any specific act has been attributed against the petitioner.
In view of the facts and circumstances of the case, The petitioner being a lady, in the event of the petitioner's arrest or surrender before the court below within four weeks from the date of communication of this order, let the above named petitioner be released on bail on her furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Shachi Mishra, Judicial Magistrate 1st
