JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Petitioner no.1 is the elder brother of the husband of the deceased. Petitioner no.2 is the father-in-law of the deceased and petitioner no.3 is the wife of the brother of the husband of the deceased.

Drawing my attention to the First Information Report, learned counsel appearing on behalf of the petitioners submits that there is no allegation of demand of dowry by these petitioners

Patna High Court Cr.Misc. No.12870 of 2015 (3) dt.30-07-2015 immediately before the death of the deceased. He accordingly, submits that no offence under Section 304B of the Indian Penal Code is made out against these petitioners. He further submits that admittedly, the deceased was taken to the Hospital by the accused person which shows that they are not responsible for the death of the deceased.

In view of the submissions as above, let petitioners above named in the event of their arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in Yadopur P.S. Case No. 8 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
