JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special Case No. 495 of 2018 arising out of Jakkanpur P.S. Case No. 29 of 2018. for the offenses under Sections 30(A),38, 41 and 47 of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and nothing was recovered from conscious possession of the petitioner. He further submits that similarly circumstanced co-accused Parshuram Yadav has been granted bail in Cr. Misc. No. 19523 of 2018 vide order dated 10.5.2018 passed by a Co-ordinate Bench of this Court. Considering the aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.39627 of 2018(2) dt.09-07-2018 2/2 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (Excise), Patna in connection with Special Case No. 495 of 2018 arising out of Jakkanpur P.S. Case No. 29 of 2018.
