Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 307/34 of the I.P.C and Section 27 of the Arms Act. It is alleged that this petitioner, his brother Anil Kumar and Sanjay Patel came on motorcycle and Anil Kumar caused fire arm injury to the informant. It is submitted by learned counsel for the petitioner that accusation of firing is not against the petitioner. There is nothing on record to suggest that petitioner was anyway connected with the Anil Kumar whereas informant is accused in a case registered for the murder of father of the petitioner.

A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.46715 of 2014 (2) dt.23-04-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. Case No. 523 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
