The petitioner, who is in custody, seeks bail in connection with Parbatta (Maraiya) P.S. Case No. 349 of 2017 registered for the offence punishable under Section 392 of the Indian Penal Code.

Informant Ranjit Kumar Singh, who in his fardbeyan has stated that on 10.10.2017 at about 1.15 AM while he was returning to his house alongwith other relatives on Alto car, the car was stopped by four unidentified miscreants and looted cash and other articles from him and his relatives. It has been further stated in FIR that he can recognize the miscreants if they are brought before him.

No.39708 of 2018(2) dt.11-07-2018 2/2 Learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case only on the basis of confessional statement made by one co-accused Pankaj Sharma. He has no criminal antecedent and recovery of alleged articles, on the basis of confessional statement made by petitioner is not looted articles which has been seized by the police and he has not been put on T.I.P. It has further been submitted that petitioner is in custody since 11.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Khagaria, in connection with Parbatta (Maraiya) P.S.
