JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Makhdumpur P.S. Case No. 269 of 2020, registered for the offences punishable under Section 135 of Electricity Act. As per allegation, due to act of present petitioner the South Bihar Power Distribution Company has sustained a loss of Rs. 3,20,856/- as he has committed the electric theft.

Learned counsel for the petitioner has submitted that the petitioner is ready to make payment of the entire money. It has been assured that the first installment of rupees one lakh shall be deposit at the time of furnishing of the bail bond and rest amount shall be

Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity), Magadh Division, Gaya in connection with Makhdumpur P.S. Case No. 269 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. With additional condition that the court below shall accept the bail bond only after receiving the deposit slip of rupees one lakh. It is further observed that if the entire money is not paid within stipulated period i.e. three months, the court below shall cancel the bail bond of the present petitioner.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
