In this case, the petitioner is seeking anticipatory bail in connection with Hawai Adda P.S. Case No. 255 of 2018 registered for the offence under Sections 363 and 366/34 of the Indian Penal Code.

Allegation has been made that the petitioner has kidnapped the daughter of the informant. However, the girl in her statement recorded under Section 164 of the Cr.P.C. has stated that she has voluntarily gone with the petitioner and entered into the marriage with him.

Looking to the aforesaid facts, let the above-named petitioner be released on anticipatory bail in the event of his

Patna High Court CR. MISC. No.50372 of 2019(2) dt.13-08-2019 2/2 arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Patna, in connection with Hawai Adda P.S. Case no. 255 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
