No. 13627 of 2015 to the extent of extending the period of deposit of undertaken amount of Rs.2,00,000/-.
The petitioner was preferred Cr. Misc. No.
13627 of 2015 with a prayer for anticipatory bail in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.
The petitioner being rice miller was supplied
Patna High Court Cr.Misc. No.17632 of 2016 (2) dt.04-05-2016 2/3 certain paddy for supplying Custom Milled Rice but the petitioner filed to supply to the extent of 1244.90.980 quintals worth Rs.23,69,225/-.
On submission of learned counsel for the petitioner that the petitioner is ready to deposit Rs.2,00,000/- the petitioner was granted provisional anticipatory bail for six months. The provisional bail was to be confirmed by the learned court below on deposit of undertaken amount of Rs.2,00,000/-. It is submitted by learned counsel for the petitioner that the petitioner has not deposited the undertaken amount in stipulated period but now the same has been deposited. This fact has not been controverted by Mr. R.S. Pradhan learned counsel appearing for BSFC.
It is further submitted by learned counsel for the petitioner that the bail bond of the petitioner has not been cancelled till date.
In view of the above facts, the provisional anticipatory bail granted to the petitioner vide order dated 12.05.2015 in connection with Madhubani P.S. Case No. 20 of 2014 pending in the court of learned Chief Judicial Magistrate, Madhubani is, hereby, confirmed, in case the bail bond of the petitioner has not been cancelled till date.
Patna High Court Cr.Misc. No.17632 of 2016 (2) dt.04-05-2016 3/3 Accordingly, this modification application is disposed of.
