2. The petitioner is apprehending his arrest in connection with Dhansoi P.S. Case No. 38 of 2024 instituted for the offences under Sections 147, 148, 149, 341, 323 and 302 of the Indian Penal Code.

3. The allegation against the petitioner along with others is of brutally assaulting the husband of the informant leading to his death.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He further submitted that on similar footing the other co-accused persons namely, Ramayan Singh

Patna High Court CR. MISC. No.53388 of 2024(4) dt.09-12-2024 2/2 and Nitish Kumar have already been granted bail vide order dated 25.07.2024 passed in Cr. Misc. No. 42056 of 2024 by a Co-ordinate Bench. Moreover, the petitioner is a person of clean antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the aforesaid facts and circumstances as also the fact that the other co-accused persons have already been granted bail, let the petitioner, above named, in the event of arrest/surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Buxar in connection with Dhansoi P.S. Case No. 38 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
