====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.2.2018, seeks bail in Nathnagar PS Case No. 405 of 2017 registered under Sections 25(1b)a, 26 and 35 of the Arms Act. The allegation in brief is that the informant, police officer, reached at the place of occurrence for recovery of kidnapped person in connection with Madhusudanpur PS Case No. 403 of 2017, where three persons had turned up for receiving ransom money, out of whom two were apprehended and from possession of one of them country made pistol was recovered, from possession of Chhote Lal some instrument was recovered while the third person escaped away.
Learned Counsel for the petitioner submits that the petitioner was not apprehended at the spot, his name was wrongly disclosed by the apprehended two accused persons, he has no criminal antecedent, moreover Chhote Lal, who was apprehended at the spot, was granted bail by a coordinate Bench of this Cr vide Cr. Misc No. 18558 of 2018.
Having considered the said facts and circumstances, the petitioner, namely, Ravi Tanti is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst, Bhagalpur in connection with Nathnagar PS Case No. 405 of 2017.
