1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.

2. The petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code in connection with Hajipur Town P.S. Case No.940 of 2021.

3. The learned counsel for the petitioner submits that the petitioner had moved this Court earlier for seeking regular bail by filing Cr. Misc. No.29754 of 2022 but the same was rejected by order dated 10.02.2023.

4. It is submitted however liberty was granted to the petitioner to renew his prayer for bail after framing of charge. It is also submitted that charges have been framed and the petitioner assures that he will not abscond rather will cooperate in the trial and shall ensure that the trial is concluded expeditiously.

5. The learned counsel appearing on behalf of the informant fairly submits that since petitioner was granted the liberty to renew his prayer for bail after framing of charge, as such he is not opposing the regular bail application of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No.940 of 2021, subject to condition that one of the bailor of the petitioner shall be his father, Ram Naumi Bhagat @ Ram Navami Bhagat.

7. However, in the event if the learned trial court comes to a conclusion that petitioner after being released on bail

Patna High Court CR. MISC. No.56480 of 2024(2) dt.31-08-2024 3/3 is trying to delay the trial in any manner, the trial court would be at liberty to forthwith cancel the bail bonds of the petitioner and to take all coercive steps to ensure that petitioner is behind bar.
