The petitioner being the husband of the complainant is apprehending his arrest in a Complaint Case No. 1905 of 2014 wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code, pending in the court of learned Judicial Magistrate, Ist Class, Araria. The basic accusation is of torture.

This Court vide order dated 31.03.2015 issued notice to the complainant-opposite party no. 2. The order dated 14.09.2015 reflects that none appears on behalf of the petitioner

Patna High Court Cr.Misc. No.13199 of 2015 (5) dt.21-09-2015 2/2 whereas opposite party no. 2-complainant was present with her lawyer. As a last indulgence the matter was adjourned for today i.e. 21.09.2015, but today also none appears for the petitioner. However, counsel for the complainant is present and submits that the complainant is ready to resume conjugal life. Accordingly, this application is disposed of with a liberty to the learned court below to consider the prayer for regular bail of the petitioner keeping in view of the stand of the complainant.
