JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-07-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 5347 of 2019, arising out of Shastri Nagar P.S. Case No. 528 of 2019, for the offence under Section 379 of the Indian Penal Code and Section 37(b)(c) of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is that he snatched the mobile of the informant and when the petitioner was apprehended by the police he was found to be intoxicated condition.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 16.06.2019.

No.47809 of 2019(2) dt.31-07-2019 2/2 Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Special Case No. 5347 of 2019, arising out of Shastri Nagar P.S. Case No. 528 of 2019.
