JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-05-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This application for anticipatory bail arises out of Shahpur P.S. Case No.
of 2015, disclosing offences under Sections 147,148,149,323,324,337,338,307,504 of the Indian Penal Code. Considering the gravity of the offence and the manner of occurrence as alleged in the First Information Report, I am not inclined to grant the petitioners, privilege of anticipatory bail.
Learned counsel for the petitioners has submitted that some of the similarly circumstanced co-accused persons have been granted regular bail by this Court.
Accordingly, this application for anticipatory bail is rejected. The petitioners are directed to surrender before the Court below
within four weeks from today and seek regular bail, if so advised. If he do so, their application for regular bail shall be considered on its own merit, without being prejudiced by rejection of present application for grant of anticipatory bail.
The Court may take into account while considering the application for regular bail that some of other co-accused persons have been granted regular bail by this Court.
