1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sikty Police Station Case No. 69 of 2022, dated 16.03.2022, disclosing offences under Sections 149/341/323/379/363/365/504/506 of the Indian Penal Code.
3. The prosecution story, as per the First Information Report, is that on 05.03.2022 at about 8:00 P.M., the informant received a phone call that her daughter has been killed by her brother-in-law (devar), namely, Khurshid Alam. On receiving this information, she went to her daughter's house where persons assembled there informed her that the accused persons, including the petitioner, had
Patna High Court CR. MISC. No.53251 of 2025(3) dt.15-11-2025 2/3 assaulted her daughter, took away Rs. 1,50,000/- and a motorcycle from the shop and took the informant's daughter in four wheeler vehicle. It has further been alleged that the informant's is not traceable.
4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has false been implicated in the present on the basis of concocted story. He next submits that the victim in her statement recorded under Section 164 of the of the Code of Criminal Procedure has not made any allegation of kidnapping against the petitioner. He further submits that co-accused persons have been granted anticipatory bail by Co-ordinate Bench of this Court in Cr. Misc. No. 6596 of 2025, Cr. Misc. No. 84552 of 2024, Cr. Misc. No. 28152 of 2024, Cr. Misc. No. 28613 of 2024, Cr. Misc. No. 21547 of 2024 and Cr. Misc. No. 66986 of 2023.
5. Having regard to the submissions made on behalf of the parties and taking into consideration the statement of victim girl recorded under Section 164 of the Code of Criminal Procedure and the fact that co-accused persons have been granted anticipatory bail by Co-ordinate Bench
Patna High Court CR. MISC. No.53251 of 2025(3) dt.15-11-2025 3/3 of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Sikty Police Station Case No. 69 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
