Petitioner, who is the married sister-in-law (Nanad) of the deceased Rubi Devi, apprehends arrest in connection with Benipatti P.S. Case No. 210/15 for offences alleged under Sections 304-B, 120-B/34 of the Indian Penal Code. The prosecution case, as lodged by the informant, is that on 28.11.2015 petitioner along with others killed the daughter of the informant by strangulation for non-fulfilment of demand of motorcycle and cash Rs. 1,50,000/-. It has been submitted by the learned counsel for the petitioner that she is innocent, no specific allegation has been made against her and on the date of occurrence she was residing at
Patna High Court Cr.Misc. No.17963 of 2016 (2) dt.06-05-2016 2/2 her sasural in village Karahi in Arer Police Station. He further submits that the husband of the deceased is in custody since 30.11.2015 and she has no criminal antecedent, as is evident from paragraph 3 of this application.
However, learned APP for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail Be that as it may, let petitioner, above named, in the event of her arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani, in connection with Benipatti P.S. Case No. 210/15, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nilu Agrawal, J.) Rajesh/- U T
