JUSTICE MUNGESHWAR SAHOO ORAL ORDER 04-08-2016 It appears that this civil miscellaneous application has been filed under Article 227 of the Constitution of India praying for a direction to the Judicial Magistrate, 1st Class, Araria -cum- 1st Additional Munsif to dispose of Title Suit No. 97 of 2006 on day to day basis.

Learned counsel for the respondent-State submitted that this civil miscellaneous application is not maintainable. In this application, no order passed by the civil court is under challenge. This Court is not exercising original jurisdiction. Therefore, for the relief claimed by the petitioner, this civil miscellaneous application under Article 227 of the Constitution of India is not maintainable. Accordingly, this civil miscellaneous application is dismissed.
